Avec deux instituts en Inde (Kerala) affiliés, il s’agit jusqu’à présent de la seule faculté au monde qui est entièrement dédiée à l’enseignement du CCEO (\u003ci\u003eCodex Canonum Ecclesiarum Orientalium\u003c\/i\u003e = Code des Canons des Eglises Orientales). Les pères Ivan Žužek S.J. et George Nedungatt S.J. ainsi que le prof. Carl Gerold Fürst qui furent tous professeurs au PIO, ont largement contribué à la conception et la rédaction du CCEO de 1990. \u003c\/p\u003e\n\u003cp style=\"text-align: justify;\"\u003eCe site est dédié à la promotion et la divulgation des publications de \u003ci\u003eKanonika\u003c\/i\u003e et se profile ainsi comme la continuation d’une vénérable tradition de réflexion et de recherche. La série \u003ci\u003eKanonika\u003c\/i\u003e, fondée en 1992, est essentiellement dédiée à l’étude du droit canon des Eglises orientales (catholiques et orthodoxes). Jusqu’en mars 2012, le père George Nedungatt S.J. en fut éditeur en chef pour bien vingt ans. \u003ci\u003eKanonika \u003c\/i\u003ecomporte des œuvres de plusieurs genres allant de commentaires sur le CCEO à des études comparatives entre le CIC et le CCEO en passant par l’édition critique de sources, des monographies ainsi que l’édition d’actes de colloques et de séminaires. \u003c\/p\u003e\n\u003cp style=\"text-align: justify;\"\u003eDepuis avril 2014, avec la sortie de \u003ci\u003eKanonika 20\u003c\/i\u003e, la série a été dotée d’un nouveau logo et d’un format différent pour la version imprimée sur papier, ceci grâce à la collaboration entre \u003ci\u003eEdizioni Orientalia Christiana\u003c\/i\u003e et le coéditeur \u003ci\u003eValore Italiano srl\u003c\/i\u003e. The work first focuses on the early jurisprudence concerning the binding force of papal legislation on Eastern faithful, highlighting an important though unapproved decision made by a particular congregation of the Sacred Congregation for the Propagation of the Faith in 1631, which declared that the popes did not intend to bind the subjects of the sees of the schismatic patriarchs by certain types of apostolic constitutions except in three particular cases. The work then reviews the jurisprudence of Pope Benedict XIV, who cited this decision three times in his writings; the events of the pontificate of Pope Pius IX, particularly those surrounding the First Vatican Council when the preconciliar commission on the Churches of the Eastern rite sought to suppress the praxis based on this decision; the period of the first codification of canon law, when this decision was reaffirmed in praxis; and, finally, the Second Vatican Council and the second codification period, when this decision became the basis for canon 1492 of the Eastern code. This study emphasizes the impact that the jurisprudence surrounding the 1631 decision has had on how the understanding of Eastern juridic autonomy has developed in the Catholic Church. Questa Sezione canonistica fu istituita il 2 luglio 1963. Dopo otto anni, cioè nel 1971, la medesima Sezione fu elevata da Papa Paolo VI alla dignità di Facoltà di Diritto Canonico Orientale. Tuttora è l’unica facoltà di diritto canonico orientale al mondo. Il simposio, a cui hanno partecipato non pochi docenti della Facoltà di Diritto Canonico, dimostra la sua perenne fedeltà al mission statement che gli fu dato da Papa Paolo VI, cosicché “la schiera dei canonisti, destinati a studiare, interpretare e stabilire le consuetudini e le leggi delle Chiese dell’Oriente cristiano, cresca e fiorisca sempre più pienamente, affinché tutti siano finalmente sempre più pronti a cercare di conservare l’unità dello spirito per mezzo del vincolo della pace…: un solo Signore, una sola fede, un solo battesimo, un solo Dio e Padre di tutti, che è al di sopra di tutti, agisce per mezzo di tutti ed è presente in tutti”. Questa sorta di Lexikon della penitenza tariffata è il risultato ottenuto dalla comparazione strettamente testuale dei Libri pœnitentiales (detti in Oriente Kanonaria) latini, greci e slavi, con la quale l’Autore ha creato degli Indices (in lingua latina) che, come strumenti di consultazione, consentono di entrare in modo diretto nel mondo di questa prassi penitenziale medioevale. Il progetto degli Indices, scopo precipuo dell’Opera, si propone di far “toccare con mano” le differenze e le analogie, le soluzioni pastorali totalmente contrastanti o pressoché simili, le coerenze o le contraddizioni di cui questi canones penitenziali sono testimoni. L’Opera fornisce pertanto le basi necessarie per l’elaborazione di una teologia liturgico-canonica comparata della penitenza tariffata, senza per questo pretendere di sciogliere i nodi della complessità che emerge dallo studio di queste fonti. Offre invece una conoscenza articolata dei testi (l’obiectum primario della scientia liturgica) di questa prassi pastorale della Chiesa del primo medioevo, protrattasi – nella sua forma più pura – fino a tutto il XII secolo, punto d’arrivo dell’epoca d’oro dei Penitenziali. A knowledge of the Codes as different, however, is not the only reason why comparative studies are useful. The autbor shows that knowing these differences is often necessary and a matter of practical importance. This will be true, for example, in cases of interritual marriage, in providing for the pastoral care of Eastern Catholics entrusted to the care of a Latin bishop, or even in applying different procedural rules when Latin canonists serve on an Eastern tribunal. It is also evident from the studies’ findings that the Eastern and Latin Codes are not so distinctly separate as to be unrelated. The author explains that there are Eastern canons which expressly (explicitly\/ implicitly) also affect the Latin Church. Comparative studies, then, serve to define more clearly the interrelation between the two Codes. On the basis of his comparative studies, the author is convinced that canonists are only beginning to reap the benefits that were evidently intended by the pope’s call for such studies of the Eastern and Latin Codes.
